Can you provide the following information under the Freedom of Information Act. 

I have attached PCS(AFC) 2007/7 (PCS(AFC)2007/7 - Definition of contractual overtime for the purposes of the Agenda for Change terms and conditions handbook) it's states - ...or a commitment by an employee to work whereby the individual employee enters unto an agreement to undertake overtime at a given time or frequency by which time they can only leave by arrangement..." 

Does this apply to part-time staff who work excess their contracted hours on a weekly basis, working the same day and shift for an extended period of time?

 Part-time staff are not paid overtime rates until they have worked more than 37 hours per week.  Any additional hours over their contracted hours are paid at basic rate plus any enhancements they are due.   

 

Staff are only obliged to work their contracted hours and therefore any overtime worked is on a voluntary basis.   The circular quoted (PCS(AFC)2007/7 - Definition of contractual overtime for the purposes of the Agenda for Change terms and conditions handbook) pertains to contracted overtime hours – staff are not contractually obligated to undertake overtime hours and therefore this circular would not apply.
